In the 2024 election, a proposal to amend Florida’s constitution to include abortion rights failed to pass. As of now, the state’s existing abortion laws remain in effect. Knowing what these laws mean is key to knowing your pregnancy options and what is required in the state of Florida. 

Six-Week Abortion Ban

In the state of Florida, the Heartbeat Protection Act now prohibits abortions after six weeks of pregnancy, except in cases when:

  • The mother’s life is at risk
  • The fetus has a fatal abnormality. 
  • At 15 weeks in the case of sexual assault, incest, or sex trafficking.

This means that most abortions must be done before a detectable heartbeat, which could be as soon as six weeks.  

Florida also requires parental consent for women seeking abortions who are under 18 years old. This requires a parent or legal guardian to provide written approval before an abortion procedure is done.

In-Person Appointments & Waiting Period

Florida law requires a mandatory 24-hour waiting period before going about an abortion procedure. Women are required to attend two separate in-person appointments, which include: 

  1. First, there is an appointment that includes lab work, an ultrasound, educational resources, and a consultation with a physician.
  2. Second, there is an appointment for the actual abortion procedure (at least 24 hours after the initial visit).

Telemedicine is Prohibited 

The abortion pill can’t be prescribed online by law in the state of Florida. The state prohibits telemedicine for all abortion services, and physicians must dispense drugs for medical abortions in person. This new Florida policy requires women who want a medical abortion to visit a clinic in person.
